Terms and conditions of use & Privacy policy

This policy together with any other documents provided by the Data Controller to you, or which are available on any website(s) provided, or operated, by the Data Controller ("the Website(s)") (together, the "Terms") set out the basis on which any personal data the Data Controller collects from you, or that you provide to the Data Controller, will be managed and processed in accordance with the Act. By providing information under the Terms you agree to only bring a claim, for breach of the Terms, against the Data Controller and no other member of the Mship group.

Please read the following carefully to understand the Data Controller's practices and processes regarding your personal data and how the Data Controller will manage it.

Information we may collect from you

The Data Controller may collect and process the following data about you:

  • Information that you provide to the Data Controller by registering on the Website(s). This includes personal and sensitive data, company details and other information provided at the time of registering to use the Website(s); information that you provide by filling in forms on the Website(s), subscribing to the Data Controller services/products, posting material or requesting further services/products. Please note that this may include company details, personal and sensitive data;

  • details of any transaction you carry out through the Website(s);

  • if you contact the Data Controller, such as to report a problem with the Website(s), the Data Controller may keep a record of that correspondence;

  • information that you provide when responding to surveys that the Data Controller uses for research purposes, although you do not have to respond to them; and

  • details of your visits to the Website(s) and the resources that you access, including but not limited to, traffic data, location data, weblogs and communication data.

IP addresses

The Data Controller may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to the Data Controller, and the Data Controller's advisors and/or suppliers. This is statistical data about the Data Controller's users' browsing actions and patterns, and does not identify any individual.

If you access the Website(s) the Data Controller may use cookies to distinguish you from other users of the Website(s). This helps the Data Controller to provide you with a good experience and improve the Website(s). Where we store your personal data

The data that the Data Controller collects from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for the Data Controller, the Mship Group or for one of the Data Controller's suppliers when providing products and/or services to you. Such staff may be engaged in, among other things the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. The Data Controller will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

All information you provide to the Data Controller is stored on the Data Controller's secure servers. Where the Data Controller has given you (or where you have chosen) a password which enables you to access certain parts of the Website(s), you are responsible for keeping this password confidential. Unless the Data Controller explicitly agrees otherwise, the Data Controller requires you not to share your password with anyone and to inform the Data Controller promptly should you believe that the security of the password has been compromised. You should also inform the Data Controller in the event you cease to work for your company or you no longer require access to the Website(s).

Unfortunately, the transmission of information via the internet is not completely secure. Although the Data Controller will use reasonable efforts to protect your personal data, the Data Controller cannot guarantee the security of your data transmitted to the Website(s); any transmission is at your own risk. Once the Data Controller has received your information, the Data Controller will use strict procedures and security features to try to prevent unauthorized access.

The term "Mship" means (i)  (a public company registered in Antigua and Barbuda, WI) and (ii) all of its Affiliates including Us. The term "Affiliate" of Mship means any person that directly or indirectly through one or more intermediaries, controls, or is controlled by, or is under common control with, Mship. The term "control" (including the terms "controls", "controlled by" and "under common control with") means the possession, direct or indirect, of the power to direct or cause the direction of the management, policies or activities of a person, whether through one or more intermediaries, controls, or is controlled by, or is under common control with, Mship. Any other member of the Mship group to which such personal information is disclosed shall have the same rights to use such data as the Data Controller.

We may disclose your personal information to third parties:

  • if it is required to provide you with products and/or services that you have requested from Us;

  • in the event that We sell or buy any business or assets, in which case We may disclose your personal data to the prospective seller or buyer of such business or assets;

  • if all or substantially all of Our assets are acquired by a third party, in which case personal data held about Our customers may be one of the transferred assets;

  • if We are under a duty to disclose or share your personal data in order to comply with any legal obligation; and

  • in order to enforce or apply Our Terms.

Your rights

You have the right to ask the Data Controller not to process your personal data for marketing purposes. The Data Controller will usually inform you (before collecting your data) if the Data Controller intends to use your data for such purposes or if the Data Controller intends to disclose your information to any third party for such purposes.

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee to meet the Data Controller's costs in providing you with details of the information the Data Controller holds about you.
